Overview

Job Description :

The Senior Attorney will provide legal advice and representation to all NFA departments to support their efforts to provide the most efficient and effective regulatory environment possible.

Duties/Responsibilities:

Regulatory

  • Work with Members and Committees while also supervising NFA attorneys in developing NFA rules or interpretive guidance to address regulatory issues.
  • Prepare memoranda summarizing regulatory issues and possible solutions for NFA’s Board and other Committees.
  • Make presentations to NFA’s Board of Directors and Committees on regulatory issues.
  • Oversee the CFTC and SEC Rule Submission process.
  • Prepare Comment Letters on CFTC and other agency rule proposals.

General

  • Provide legal advice to NFA staff concerning interpretation of relevant statutes and rules.
  • Respond to Requests for Information from Members, NFA staff, members of the public and other regulatory organizations.
  • Participate on panels at industry conferences and Member workshops.

Counsel to NFA Hearing Panels

  • Oversee the administration of NFA’s disciplinary and registration hearing process.
  • Act as counsel to NFA’s Hearing Panels and oversee other attorneys acting in that capacity.
  • Draft Orders and Decisions in disciplinary and registration matters at the direction of the Hearing Panel.

Developing Others

  • Identify and provide appropriate training and work assignments to enable NFA staff and Senior Attorneys to learn and develop necessary skills for advancement.

Projects

  • Provide input on strategic planning and participate in major departmental and interdepartmental project team activities.

Requirements:

  • Graduation from law school and admission to the Illinois Bar (or ability to become admitted) Experiences as a practicing attorney with a focus on derivatives and securities laws
  • Proficiency at conducting legal research
  • Ability to engage in analytical thinking by using a logical approach to address problems and issues
  • Identify and address new and complex problems and issues
  • Engage in conceptual thinking by understanding situations through piecing together information in order to see the larger picture.

•Express thoughts clearly and concisely, both in writing and orally, in presentation directed to both lawyers and non-lawyers

•Effectively communicate with NFA staff, Committees, Members, members of the public and representatives of other regulatory bodies, including the ability to anticipate what needs to be communicated in light of the audience

•Use both internal and external networks to obtain information and perspectives in order to accomplish tasks and to identify opportunities for NFA

•Efficiently and effectively work on multiple assignments, coordinate, prioritize and plan the work of others on multiple assignments and ensure that quality results are produced in a timely manner

•Tactfully engage NFA management, Committees, Members and representatives of other regulatory organizations in frank discussions to resolve difficult problems and issues •Use complex strategies, provide information to other Departments and share resources to promote NFA’s effectiveness
